In a settlement agreement filed in federal court on June 22, 2017, the City of Hillsboro Illinois agreed to continue abiding by the terms of a 23-year-old lease agreement it had threatened to terminate on property on Glenn Shoals Lake. The suit was filed by Thomas and Karen Burkart. The suit claims that the city had violated the fifth and fourteenth amendments to the U.S. Constitution by depriving the defendant property owners of due process and their rights to private property. In addition to agreeing to pay the $400 federal court filing fee and $5,000 in attorney fees, according to the settlement agreement, the city agreed to abide by the terms of the 1994 lease.
